Court Records of Schuylkill County Regarding Hopkin Thomas

 

Record No. 5, dated 1/31/1848

 

 

This is a deed from John Ollis and his wife, Elizabeth, conveying three lots (No. 154, 155, and 156) to John Ollis and Hopkin Thomas, doing business as Thomas & Ollis.

 

These lots are located on the west side of Rail Road St. in Tamaqua and are part of the location of the Thomas & Ollis machine shop. Note that the array of lots conveyed to Thomas & Ollis is said to be bounded on the North by Vine Street.  This concurs with the location as identified in Beers Atlas of 1872. This Indenture made the thirty first  day of January in the year of our Lord 1848 between  John Ollis, of the Borough of Tamaqua Schuylkill County and State of Pennsylvania and Elizabeth, his wife of the one part and Hopkin Thomas and John Ollis, transacting business under the firm name of Thomas & Ollis of the Borough, County and State aforesaid Machinists and Iron Founders of the other part. Witnesseth that the said John Ollis and Elizabeth, his wife, for and in consideration of the sum of $360.00 lawful money of the United States of America unto them well and truly paid by the said Thomas & Ollis at and before the sealing and delivery of these presents the receipt whereof is hereby acknowledged have granted, bargained, sold aliened, enfeoffed,  released and confirmed and by these presents do  grant, bargain, sell alien enfeoff,  release and confirm unto the said firm of Thomas and Ollis their heirs and assigns All those three certain lots or pieces of ground situate in the Borough of Tamaqua aforesaid being lots  marked in Wilson and Levans addition to the Borough of Tamaqua aforesaid with the numbers No. 155, 156, situated on the west side of a street called Rail Road Street. Each lot containing in front on said Rail Road Street 20 feet and 8/12th of a foot making in all 62 feet on said Rail Road Street and extending back of that width 130 feet to a 60 feet wide street bounded on the North by Vine Street on the South by Lot #153 on the East by Rail Road Street and on the West by said 60-feet wide street, the same being a part of what is known as the Baum Tract, and which Thomas Wilson and Julia A., his wife and William Levan and Mary Ann, his wife, by their indenture

bearing date the fourteenth of May 1847 granted and confirmed unto John Ollis herein named in fee  reserving nevertheless all minerals and the right of tunneling, mining, and removing the same together  with all and singular the buildings and improvements ways, waters, water courses, rights, liberties, privileges, hereditaments and appurtenances whatsoever thereunto belonging or in anywise appertaining anew the reversions and remainders rents, issues, and profits thereof and all the estate right title interests, property claim and demand whatsoever of them the said John Ollis and Elizabeth, his wife in law equity or otherwise howsoever of, in, and to the same and every part thereof.  To have and To Hold the said above described three lots of ground hereditaments  and premises hereby granted or mentioned and intended so to be with the appurtenances unto the said Thomas and Ollis their heirs and assigns  to and for the only proper use and behoof of the said Thomas and Ollis aforesaid heirs and assigns to and for the only proper use and behoof   of  the said Thomas and Ollie as aforesaid their heirs and assigns that he the said John Ollis his heirs executors and administrators doth by these presents covenant, grant, and agree to and with the said Thomas & Ollis their heirs and assigns  and singular the hereditaments and premises herein above described and granted or mentioned and intended so to be with the appurtenances unto the said Thomas and Ollis their heirs and assigns against him the said John Ollis his heirs and against all and every other person or persons whomsoever lawfully claiming or to claim the same or any part thereof by him or under him or either of them shall and will warrant and forever defend.  In witness whereof of the said parties to these presents have hereunto interchangeably set their hands and seals. Dated the day and year above written. Date of this indenture altered from December 23rd 1447 to January 31st 1848.

Received the day of the date of the above Indenture of the above named Thomas & Ollis $360.00 in full of the consideration money above mentioned.  Witness:

On the thirty-first day of January Anno Domini 1848, before me the Subscriber one of the Justices of the Peace in and for said County of Schuylkill , personally appeared the above named John Ollis and Elizabeth, his wife, and in due form of Law acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such, and the said Elizabeth, being of full age and separate and apart from her said husband, by me thereon

privately examined and the full contents of the above deed being by me first made known unto her, did thereupon declare and say that she did voluntarily and of her own free will and accord sign, seal and as her act and deed deliver the above written Indenture, deed or conveyance without any coercion or compulsion of her said husband. Witness my hand and seal the day and year aforesaid.
