Recorded
herein is a deed from Hopkin Thomas and his wife, Catharine, conveying three
lots purchased by Hopkin Thomas in September 1847 (See Record No. 3) ( No.s 151, 152, and 153) to John Ollis and Hopkin Thomas,
doing business as Thomas & Ollis (Machinists and Iron Founders).
These
deeds convey lots located on the west side of Rail Road St. in Tamaqua to the
firm of Thomas & Ollis These lots are most probably the location of
HopkinÕs future machine shop. This is the first mention of HopkinÕs partner,
John Ollis.

Note
that the year of the transfers is 1848 and Hopkin Thomas is identified as be Òof
TamaquaÓ. This implies that Hopkin
had moved his residence to Tamaqua
between September 1847 and January 1848.

This Indenture
made the thirty first day of
January in the year of our Lord 1848 between Hopkin Thomas, of the Borough of Tamaqua Schuylkill County
and State of Pennsylvania and Catherine, his wife of the one part and John
Ollis and Hopkin Thomas , transacting business under the firm name of Thomas
& Ollis of the Borough, County and State aforesaid Machinists and Iron
Founders) of the other part. Witnesseth that the said Hopkin Thomas and Catherine,
his wife, for and in consideration of the sum of $330.00 lawful money of the
United States of America unto them well and truly paid by the said Thomas &
Ollis at and before the sealing and delivery of these presents the receipt
whereof is hereby acknowledged have granted, bargained, sold aliened, enfeoffed, released and confirmed and by these
presents do grant, bargain,
sell alien enfeoff, release and confirm unto the said Thomas and Ollis as
aforesaid their heirs and assigns All those three certain lots or pieces of
ground in the Borough of Tamaqua aforesaid and marked in the plan of said
addition with the numbers No. 151, 152, and 153 situated on the west side of a street called Rail Road
Street and each lot containing in front on said Rail Road Street fronting each
for 20 feet and 8/12th of a foot on said Rail Road Street and
extending back of that width 130 feet to a 60 feet wide street, the same being
a part of what is known as the Baum Tract, excepting and reserving nevertheless
all minerals and the right of tunneling, mining, and removing the same together with all and singular the buildings and improvements ways,
waters, water courses, rights, liberties, privileges, hereditaments and appurtenances
whatsoever thereunto belonging or in anywise appertaining anew the reversions
and remainders rents, issues, and profits thereof and all the estate right
title interests, property claim and demand whatsoever of them the said Hopkin
Thomas and Catherine, his wife in law equity or otherwise howsoever of, in, and to the same and every part thereof.
To have and To Hold the said three lots of ground hereditaments and premise hereby granted or mentioned
and intended so to be with the appurtenances unto the said Thomas and Ollis
their heirs and assigns to and for
the only proper use and behoof of the said Thomas and Ollis aforesaid heirs and
assigns forever. And the said Hopkin Thomas his heirs, executors and
administrators doth by these presents covenant, grant, and agree to and with
the said Thomas and Ollie as aforesaid their heirs and assigns that he the said
Hopkin Thomas his heirs all and singular the hereditaments and premises herein
above described and granted or mentioned and intended so to be with the
appurtenances unto the said Thomas and Ollis as aforesaid their heirs and
assigns against him the said Hopkin Thomas and his heirs and against all and
every other person or persons whomsoever lawfully claiming or to claim the same
or any part thereof by from or under him or either of them shall and will
warrant and forever defend. In
witness whereof of the said parties to these presents have hereunto
interchangeably set their hands and seals. Dated the day and year above
written.
Sealed and Delivered in the presence of us. Date of this
indenture altered from December 23rd 1847 to January 31st,
1848.
Received
the day of the date of the above Indenture of the above named Thomas and Ollis $330.00
in full of the consideration money above mentioned. Witness:

Schuylkill County
On the thirty-first day of January Anno Domini 1848, before me the Subscriber a Justice of the Peace in and for said County of Schuylkill, personally appeared the above named Hopkin Thomas and Catherine, his wife, and in due form of Law acknowledged the above Indenture to be their act and deed and desired the same might be recorded as such, and the said Catherine, being of full age and separate and apart from her said husband, by me thereon privately examined and the full contents of the above deed being by me first made known unto her, did thereupon declare and say that she voluntarily and of her own free will and accord sign, seal and as her act and deed deliver the above written Indenture Deed or Conveyance without any coercion or compulsion of her said husband. Witness my hand and seal the day and year aforesaid.
